Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Registration

Accept responsibility for all activities under your account

You retain full ownership of your content. Any audio files, setlists, contacts, comments, and other materials you upload or create ("Your Content") remain your property. We claim no ownership rights over Your Content.

By uploading content, you grant us a limited license to:

Create backups for data protection purposes
Share Your Content with users you explicitly authorize (e.g., collaborators, band members)

This license is non-exclusive, royalty-free, and exists solely for the purpose of operating the Service. We will never use Your Content for marketing, AI training, or any purpose outside of providing the Service to you.

Subscription and Payment

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGCOVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Termination

Upon termination:

We may delete Your Content after a reasonable period
Provisions that should survive termination will remain in effect

You may request an export of Your Content before termination.

Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

Informal Resolution: Contact us at first. We'll try to resolve disputes informally within 30 days.
Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Dallas, Texas, under the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

General Provisions

Entire Agreement: These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and GigCove.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any right does not waive that right.
Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
